Terms of service
These terms of service (the "Terms of Service") govern access to the olfaparfum.fr website (the "Site") and its use by any person who visits it, whether or not they place an order (the "User", "you"). Purchases concluded on the Site are, for their part, governed by the terms and conditions of sale (the "Terms"): orders, prices, delivery, withdrawal and legal warranties are dealt with there in full.
1. Publisher of the Site and scope
The Site is published by Aroma Logistics Co, sole proprietorship (EI, French sole-trader status of "entrepreneur individuel"), operating under the trade name "Olfazeta by Chogan" (the "Publisher", "we"):
- Place of business: 231 rue Saint-Honoré, 75001 Paris, France;
- SIREN 102 212 289 — activity 47.91B, distance selling via specialised catalogue;
- "TVA non applicable, article 293 B du code général des impôts" (VAT not applicable, article 293 B of the French General Tax Code — basic VAT exemption scheme);
- E-mail: help@olfazeta.fr — online assistance available on the Site.
The Site is hosted by means of the Shopify platform; the full identity of the host appears in section 1 of the Terms.
These Terms of Service apply to any use of the Site: viewing pages, creating and using a customer account, publishing a review, using the online assistant. As soon as you place an order, the Terms also apply to that order. Where these Terms of Service refer to a section of the Terms, that section applies to every User of the Site, whether a customer or not; in the event of a discrepancy between the two documents, the text of the Terms prevails, and on any point affecting your consumer rights, the most favourable provision applies. No stipulation of these Terms of Service may deprive you of the rights you hold under mandatory provisions of public policy.
2. Access to the Site and customer account
The Site is accessible free of charge, except for connection costs, which remain your responsibility. We use reasonable means to ensure access to it and its proper functioning, without guaranteeing uninterrupted availability: access may be suspended or restricted, in particular for maintenance, updates or security requirements. We may also change the content and features of the Site at any time. These interruptions and changes have no effect on orders already concluded, which remain governed by the Terms in force on the date they were confirmed.
The creation, use, closure and suspension of the customer account, as well as responsibility for its use, are governed by sections 2.5 and 13 of the Terms.
3. Intellectual property
All the elements of the Site — structure, texts, descriptions, photographs, videos, logos, trademarks, databases and code — are protected by intellectual property law. Your right to use the Site is personal and non-exclusive: visiting the Site transfers to you no right over its content. The bases of this protection, the penalties incurred and the reserved statutory exceptions (private copying, short quotation) are set out in section 10.1 of the Terms, which applies to every User.
4. Content published by Users
The Site may allow you to publish content, in particular reviews, ratings or photographs. Your undertakings as to the lawfulness of this content, the limited licence you grant us over it — purpose, media, territory and duration included — your right to request its removal at any time and our rules on the transparency of reviews are set out in sections 10.2 to 10.4 of the Terms, which apply to every User who publishes content, whether or not they have placed an order.
5. Prohibited uses of the Site
The prohibited uses of the Site — unlawful purposes, infringement of the rights of third parties, transmission of false information or malicious code, massive data extraction, phishing, circumvention of security measures, among others — are listed in section 11.2 of the Terms, which applies to every User. In the event of a breach, access to the Site or to the account may be suspended or closed under the conditions of section 13 of the Terms, without prejudice to any action for damages.
6. Online assistant and artificial intelligence
The Site offers an online assistant based on an artificial intelligence system. In accordance with Article 50 of Regulation (EU) 2024/1689 laying down harmonised rules on artificial intelligence, you are informed, from the start of the interaction, that you are communicating with an artificial intelligence system and not with a natural person.
The responses generated by the assistant are provided for information and convenience: they have no contractual value. The exact scope of this rule — which information alone is authoritative, the absence of medical advice, the absence of any commitment as to a price, availability or time frame — is set out in section 11.3 of the Terms, which applies to every User. The use of the assistant modifies neither your consumer rights nor our liability.
You may at any time ask to communicate with a natural person by writing to help@olfazeta.fr.
7. Links to third-party sites
The Site may contain links to sites operated by third parties, under the conditions of section 11.4 of the Terms: we exercise no control over these sites, and the presence of a link does not imply endorsement of their content. Visiting them is governed by their own terms of use and privacy policies, which we invite you to read.
8. Personal data and cookies
The processing of your personal data in connection with your use of the Site is described in our privacy policy, which sets out your rights and how to exercise them. In the event of any conflict with these Terms of Service on this subject, the privacy policy prevails.
Cookies and trackers that are not strictly necessary are placed only with your consent, which you may give, refuse or withdraw at any time via the "Manage cookies" link at the bottom of every page of the Site.
9. Liability in respect of use of the Site
The content of the Site other than the product pages, the labelling and the order confirmations — articles, guides, responses from the online assistant — is provided for general information and constitutes neither medical advice nor personalised professional advice.
We use reasonable means to ensure the accuracy, availability and security of the Site. We are not liable for damage that does not result from a breach on our part, in particular: failure of your connection or your equipment; use of the Site contrary to section 5; the act of a third-party site referred to in section 7. Nothing in this section limits our liability in cases where the law prohibits such limitation, nor restricts your rights to compensation.
Our liability in respect of sales concluded on the Site — performance of the order, delivery, conformity of the products — remains entirely governed by the Terms, in particular their section 9: this section in no way replaces them.
10. Amendment of the Terms of Service, applicable law and jurisdiction
We may amend these Terms of Service; the version in force is the one published on the Site, with its update date. Amendments apply to use of the Site after their publication and have no effect on orders already placed. If you hold a customer account, substantial amendments are notified to you under the conditions of section 13.4 of the Terms.
These Terms of Service are governed by French law. However, in accordance with Article 6 of Regulation (EC) No 593/2008 ("Rome I"), this choice may not have the result of depriving you of the protection afforded to you by the mandatory provisions of the law of the country of your habitual residence, insofar as we direct our activity to that country.
The rules on jurisdiction applicable to consumers, set out in section 14 of the Terms, apply on the same terms to any dispute relating to the use of the Site. These Terms of Service contain no waiver of the right to bring legal proceedings.
